Terms & Conditions
The City of Albany, partnered with Util360, offers an autopay Service to eligible customers as a convenient option to pay their City of Albany utility bills automatically on a recurring basis.
By enrolling in the autopay service, you agree to the following terms and conditions. Please read these terms carefully.
- Authorization for Automatic Payments: You authorize Util360 to automatically charge the utility bill amount from the credit card or bank account you specify on a recurring basis. The balance on your account will be charged on the due date of each billing cycle. Automatic Payments will be activated on the date of enrollment in the service. If the activation of Automatic Payments occurs after the due date of the last billing cycle, the payment will be processed in the next billing cycle. If the activation of Automatic Payments occurs before the due date of the last billing cycle, the payment will be processed on that due date. If the activation of Automatic Payments occurs on the due date, the automatic payment may be processed that day or in the next billing cycle.
- Payment Methods: You may use a valid credit card or provide a bank account number for Electronic Clearing House (ECH) transactions. By providing your payment details, you confirm that you are authorized to use the specified payment method, and you agree to have the account balance due charged to your credit card or bank account.
- Insufficient Funds or failed payments: If there are insufficient funds in your bank account or your credit card limit has been reached at the time of charge, you may be subject to fees imposed by your bank or credit card company. In the event of a failed payment due to insufficient funds, credit limit issues, or any other reason, you will be notified by email and/or phone. You will be responsible for making alternative payment arrangements to pay your utility bill in a timely manner. Your utility account may be subject to additional charges if your payment is rejected or refused by your financial institution. Additional fees and charges are described in the Rate Resolutions approved by the Albany City Council found at https://www.albanyoregon.gov/council/policies?m=category&cat=Fee+Schedules
- It is your responsibility to monitor your account balance and payment due dates and ensure that all your contact details are up to date in our records. Note: The City is not responsible for USPS mailing delays.
- Cancellation of Service: You may cancel automatic payments at any time by managing your preferences within your Util360 account. Upon cancellation, it is your responsibility to arrange alternative payment methods to ensure the timely payment of your utility bills.
- Liability: The City of Albany will make every effort to ensure the timely and accurate billing of your utility bills. However, The City of Albany will not be liable for any errors or failures related to the payment processing service provided by third-party payment processors or failed payments due to insufficient funds or customer error. The customer is responsible for creating the autopay account, including ensuring the accuracy of bank account or credit card details, to ensure that autopay payments can be processed. Util360 and the City of Albany shall not be responsible for failure to complete transactions when such failure is due to circumstances beyond the control of Util360 or the City of Albany, such as, but not limited to, natural disasters, failures of third parties, or interference from an outside source, which prevent the proper execution of the transaction, and Util360 and the City of Albany have taken reasonable steps to avoid such circumstances. You expressly understand and agree that your use of the service is provided on an “as is” and “as available” basis. Util360 expressly disclaims all warranties of any kind, whether express or implied.
- Indemnification: You agree to protect and fully compensate the City of Albany, its employees, agents, affiliates and service providers from any and all third party claims, liability, damages, expenses, and costs, including but not limited to reasonable attorney fees, caused by or arising from your use of the online options, your violation of the Terms and Conditions or your infringement, or infringement by any other user of your account, or any intellectual property or other right of anyone.
